As an originator of Automated Clearing House (ACH) transactions, there is a new regulatory requirement pertaining to the processing of ACH transactions that may impact you. The National Automated Clearing House Association (NACHA), a not-for-profit association that oversees the ACH Network, has changed the way ACH transactions must be handled in order to better regulate international financial transactions as required by the Office of Foreign Assets Control (OFAC), a division of the U.S. Treasury. Effective September 18, 2009, an amendment to the NACHA Operating Rules requires all payments funded internationally or sent to another country via the ACH Network to be identified as International ACH Transactions (IATs).
We want to provide you, and your employees who prepare ACH transactions, with the information and resources to plan for the new changes that took place on September 18, 2009.
Companies who originate ACH transactions need to become familiar with the new information requirements. Understanding the new rules and complying with the new regulation will allow you to continue processing ACH transactions without interruption while preventing both criminal and civil penalties, which can include imprisonment and significant fines.
